1. This is a game

CKArena is an experimental on-chain game. CryptoKitties stay in Ethereum custody while a pupil is used on Robinhood Chain. CLAW is an in-game token used to buy and burn items inside that game. Nothing on this site is an offer or sale of a security, a share of revenue, a managed account, or an investment contract.

We do not promise future utility, future features, a price, a buyer, liquidity, a listing, or any resale market. A picture of a planned feature is not a promise that it will ship. Game rules, fees, drop rates, and token amounts can change, including by a multisig transaction or a new contract.

2. Assumption of risk

You can lose the CryptoKitty you wrap, the ETH you pay, and any CLAW in a locker. Causes include bugs, exploits, faulty upgrades, key loss, a compromised relayer or signer, a paused contract, a chain halt, an RPC failure, a wallet error, and your own transaction. Blockchain transactions are irreversible. We do not custody your wallet and we cannot reverse a transfer.

By wrapping a kitty, buying CLAW, or calling any other function, you acknowledge those risks. You agree that we are not responsible for them, and you will not hold us accountable for any issue, claim, or loss arising from the use of any function this app provides.

3. No warranty

The app is provided "as is" and "as available." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the contracts are secure, error-free, or fit for mainnet use, or that a pupil, a listing, or a CLAW balance will keep any value.

4. Limitation of liability

To the fullest extent permitted by law, the operators of CKArena and their contributors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of assets, profits, data, or goodwill, whether from contract, tort, or any other theory, even if we were advised of the possibility. Our total liability for any claim arising out of the app is limited to the amount of ETH you paid to our contracts for the transaction that gave rise to the claim, or one hundred U.S. dollars, whichever is less.

5. Release

You release the operators of CKArena from claims, demands, and damages, known or unknown, arising out of your use of the app, the smart contracts, and other players' actions, including a Pit purchase or a failed wrap. If you are in a jurisdiction that limits unknown-claim waivers, this release reaches only as far as that law allows.

6. Your responsibilities

You will comply with the laws that apply to you, including sanctions and tax rules. You will not use the app if you are barred from doing so. You are responsible for your wallet, your seed phrase, and the approvals you sign. An invite to wrap is not a statement that the contracts are safe.

You will indemnify the operators of CKArena against claims, losses, and reasonable legal fees arising out of your use of the app, your content, or your breach of these terms.

7. CryptoKitties artwork

You may wrap only a CryptoKitty your wallet rightfully holds. The creator of that artwork keeps the copyright. Any right you have to use the picture comes from them, and it lasts only while you hold that CryptoKitty. These terms do not replace their license and do not grant you any right in the name, logo, or artwork.

Wrapping, fighting, or a Pit sale does not move the copyright. A Pit sale moves the Crypto Cat. It does not make the buyer the owner of the picture. You will not redraw a cat, change its colors, or register a trademark or copyright in the artwork. Kit in this game sits on top of the picture and can come off.

Merchandise, ads, and other uses of the artwork outside this game are between you and the artwork's owner, including any revenue limit they set. If a claim arises because you wrapped a cat you did not hold, or because you used the artwork outside this game, you will cover that claim under section 6.

8. The contracts

Game actions run on public smart contracts. We may pause, upgrade by deploying a replacement, or change fees. On-chain code controls when it conflicts with a description on the website. Third-party wallets, CryptoKitties, and chain operators are not our agents.

9. Changes and contact

We may update these terms by posting a new version on this page. Continued use after the update is acceptance. If a section is unenforceable, the rest still applies. These terms are governed by the laws that apply to the operators, without regard to conflict-of-law rules.
